A week and a half after the fatal car accident that critically injured comedian Tracy Morgan and killed his friend James McNair, the actor is continuing to recover.

A rep for the 30 Rock star tells Closer: "Happy to pass along that Tracy has been upgraded to fair condition, which is a great improvement. His personality is certainly starting to come back as well."

Two others traveling with Tracy were critically injured in the crash, including the 45-year-old's assistant Jeffrey Millea, whose family shares he has been upgraded to fair condition as well.

The accident, involving six-vehicles on the New Jersey Turnpike, occurred when a Walmart truck rear-ended the limousine bus carrying Tracy and his friends, causing it to tip over.

The driver of the truck, Kevin Roper, has pleaded not guilty to vehicular homicide and assault by auto. He recently went on a Twitter rant claiming he was now "fu*ked" because "I had an unfortunate ACCIDENT with the wrong car that night." He is currently out on $50,000 bond.
