After it was revealed Sherri Shepherd and husband Lamar Sally were splitting after 3 years of marriage, court documents filed by Lamar reveal the couple is expecting a child via surrogate in July.

According to the documents filed in LA Superior Court on May 2, Lamar is seeking a legal separation and full custody of their unborn son, who is due on July 28. The papers claim the baby will be named Lamar Sally Jr.

On top of asking for legal and physical custody of the child, Lamar requests that Sherri only get "reasonable" visitation rights and an order preventing her from interfering with the baby's custody after he's born.

The TV writer is also asking for spousal support, payment for his attorney fees and requests the couple's prenup be declared invalid due to fraud.

Sherri, 47, has yet to comment on the split but did take to Twitter to post a note about friendship:

The View co-host, who has struggled with infertility in the past, is already mom to son Jeffrey, 8, with ex-husband Jeff Tarpley, whom she was married to for 9 years.
