Though Sofia Vergara is now happily engaged to Joe Manganiello, her ex-fiancé Nick Loeb is embattling the actress in a court dispute over embryos she froze while they were formerly an item.
According to 'In Touch Weekly,' Nick, 39, has filed a lawsuit against the 'Modern Family' star, 42, to prevent her from destroying two cryopreserved eggs created through in vitro fertilization. The couple reportedly conceived the embryos in November 2013, just six months before they split.

Now, Nick — who filed the court documents under the pseudonym John Doe — “seeks to ensure that the Female Embryos are not destroyed, but Jane Doe [Sofia] refuses to agree to their preservation under all circumstances,” the magazine reported.

In the filing, Sofia's ex also claims she was “was physically and mentally abusive” to Nick several times during their four-year relationship. “She punched him in the face on two occasions, kicked him, and threw her phone at his head. She also routinely bullied him, calling him a ‘loser,’ ‘worthless’ and other degrading names,” the court documents state.

The papers additionally reveal the duo previously employed a surrogate with the hopes of starting a family and had embryos unsuccessfully implanted in Sofia — who is already a mom to son Manolo, 22, from a previous marriage — twice while they were together.
“Nick has always wanted to be a father and will do whatever it takes to save these two remaining female embryos,” an insider told 'In Touch.' “Nick is very emotionally invested in these female embryos because he’s pro-life and believes life begins at conception.”
